By accessing or using our software applications, data analytics platforms, dashboards, and associated services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

1. Cloud Infrastructure & Data Security

• Microsoft Cloud Hosting: All Services, data repositories, and authentication infrastructure are hosted strictly within secured Microsoft Cloud environments (including Microsoft Azure, Microsoft 365, Power BI, and Microsoft Entra ID).
• Zero Offline Student Data: CarverFranklin does not store, host, process, or maintain any student data offline or on local, unencrypted devices. All student data resides exclusively behind multi-layered, enterprise-grade security protocols, access controls, and encryption standards provided directly by Microsoft.
• Encryption Standards: Data managed within the Services is protected using industry-standard encryption protocols, both in transit (TLS 1.2 or higher) and at rest within Microsoft's cloud infrastructure.

2. User Accounts & Access Security

• Authentication: Access to the Services requires authentication via authorized enterprise credentials (e.g., Microsoft Entra ID B2B guest or member accounts).
• Credential Protection: Users are strictly responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. You agree to notify CarverFranklin immediately of any unauthorized access or security breach.
• Role-Based Access Control: Access to specific student data and analytics dashboards is strictly restricted based on administrative permissions granted by the subscribing organization (e.g., school district administrators). Users may not attempt to bypass access controls or view data beyond their explicitly authorized scope.

3. Permitted Use & Student Privacy Compliance

• Educational Purpose: The Services are provided solely for lawful educational, administrative, and data analysis purposes by authorized school district personnel, contractors, and administrators.
• Privacy Laws: CarverFranklin complies with applicable state and federal student data privacy frameworks (including FERPA and California student privacy mandates). Student data is accessed and processed solely to deliver the agreed-upon educational analytics services.
• Prohibited Conduct: Users shall not attempt to reverse engineer, decompile, scrape, export, or compromise the security architecture protecting the Services or underlying student information.

4. Limitation of Liability & Disclaimer

• Service Availability: While CarverFranklin relies on Microsoft’s standard service level agreements (SLAs) and redundant cloud architecture, the Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
• Third-Party Infrastructure: CarverFranklin is not liable for disruptions, service outages, or security incidents directly resulting from upstream failures in third-party internet service providers or core Microsoft cloud infrastructure outside of CarverFranklin's direct operational control.
